PIERRE, S.D. – Attorney General Marty Jackley commends the Attorneys General of 18 states who have filed an amicus brief that supports South Dakota in its appeal of a lower federal court ruling that temporarily prohibits the state from enforcing a new law that would criminalize the advertisement, dispensing, and distribution of dangerous abortion pills in South Dakota that don’t meet medical and legal standards.
“I appreciate my fellow Attorneys General who agree that individual States have the right to protect against dangerous pills that don’t meet medical and legal standards,” said Attorney General Marty Jackley. “Our States understand the importance of States’ rights and honoring our State law.”
In July, the U.S. District Court in Rapid City ruled in favor of Mayday Health which had requested the preliminary injunction. That decision is currently on appeal with the U.S. Court of Appeals for the Eighth Circuit. A trial on the merits of the case is anticipated to occur in 2027.
Attorneys General who joined the brief are from: Alabama, Arkansas, Florida, Georgia, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, South Carolina, Tennessee, Texas, and West Virginia.
